TERMS OF SERVICE

By creating an account or using the Gaindup platform, you agree to these Terms of Service. If you do not agree, do not use the service. You must be at least 13 years old to use Gaindup as a client, and at least 18 years old to register as a trainer.

Gaindup provides a booking platform that enables personal trainers ("Trainers") to create public booking pages and manage appointments. Clients ("Clients") can discover trainers and book sessions through the platform. Gaindup is a technology platform only — we do not employ trainers and are not responsible for the quality, safety, or legality of training services provided.

As a Trainer, you agree to:

• Provide accurate profile information and keep it up to date
• Honor confirmed bookings or cancel with reasonable notice
• Comply with all applicable laws regarding fitness instruction and personal training in your jurisdiction
• Connect your own Stripe account to receive payments — you are responsible for your own tax reporting
• Not use the platform for illegal activities or to mislead clients

Payments are processed by Stripe. Trainers connect their own Stripe accounts via Stripe Connect. By using payments on Gaindup, you also agree to Stripe's Connected Account Agreement. Gaindup does not hold funds and is not responsible for payment disputes between trainers and clients.

Each trainer sets their own cancellation and refund policy, which is displayed before booking confirmation. Gaindup is not responsible for enforcing individual trainer refund policies. See our Refund Policy for platform-level policies.

FITNESS AND HEALTH DISCLAIMER: Physical fitness activities carry inherent risks including injury. By booking a session through Gaindup, clients acknowledge:

• They are responsible for consulting a physician before beginning any fitness program
• Gaindup is a booking platform and does not provide medical or fitness advice
• Gaindup is not liable for any injury, health issue, or damage arising from training sessions booked through the platform

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAINDUP'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO GAINDUP IN THE 12 MONTHS PRECEDING THE CLAIM.

Gaindup and its logo are trademarks of Gaindup. You may not use our trademarks without written permission. Trainers retain ownership of their profile content (bio, photos, service descriptions) and grant Gaindup a license to display this content on the platform.

You may delete your account at any time via account settings. We may suspend or terminate accounts that violate these terms. Upon termination, your data is deleted according to our Privacy Policy.

These terms are governed by the laws of the State of Israel. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tel Aviv, Israel.

We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the new terms.
